Worldwide Substance and Product Registration
The Member States designate one or more places that are responsible for handling information from importers and downstream users that bring a mixture into circulation, and gather significant preventive and safety measures to be used particularly in emergencies.
This information includes the chemical composition of the mixtures placed on the market and classified as hazardous on the basis of their health and physical effects, including the chemical identity of substances in mixtures for which a request for use of an alternative chemical name has been accepted by the Agency in accordance with Article 24.
Since we already provide safety data sheets for your companies anyway, we can take over these obligations on your behalf. Likewise, all other member states have designated places for product reports. Since there is no uniform reporting/registration procedure, it is necessary to identify the designated places in all countries where you market your products. Presently, the different procedures in the member states are investigated by us.

All companies that export chemicals from outside Europe (including Switzerland) must either set up their own EU-Branch office or they need to disclose extensive confidential information to their customers so that they can meet the REACH-obligations as manufacturer /importer. The alternative would be to lose customers and profits.
This new principle in the EU means: no data, no registration – no registration, no market.
To avoid this, there is an alternative: By appointing as per law, an “Only Representative”, you can avoid the negative consequences. Your Only Representative will treat all of your data as strictly confidential and can perform all the necessary steps in the REACH-process for you and secure your markets.
The Only Representative takes over all obligations for the manufacturer who is not in the EU communinity starting with the pre-registration and registration, the creation of relevant documents such as the chemical safety report and the creation of the extended REACH safety data sheet. He must also provide and update information about the imported and supplied quantities.

The legal background - Article 8 of Regulation 1907/2006:
1. A native or legal person established outside the EU community who manufactures a substance as such, in preparations or in articles, formulates a preparation or produces a product that is imported into the EU community, may appoint by mutual consent a native or legal person established within the EU community, who fulfils the obligations for importers under this title of “Only Representative”.
2. The Only Representative also has other obligations for Importers within the framework of this regulation. For this purpose, he must have sufficient experience in the proper handling of substances, access to information about them as per Article 35 and information about the imported quantities and customer deliveries as well as information about the delivery of the latest version of safety data sheets referred to in Article 31.
3. An Only Representative is appointed in accordance with paragraphs 1 and 2, the non-EU community manufacturer shall inform the importer of the the same supply chain accordingly. For the purposes of this regulation these importers apply as downstream users.
