All companies that export chemicals from outside Europe (including Switzerland) to the EU must either set up their own EU branch in order to meet the REACH requirements or they must pass on extensive confidential information to their customers so that they can meet the REACH obligations as manufacturers/importers. The alternative would be to lose customers and therefore profit.

The new principle in the EU is: No data, no registration – no registration, no market.

There is an alternative: you can avoid the above-mentioned negative consequences by using an only representative, which is anchored in the law: Your Only Representative will treat all your data as strictly confidential and can carry out all the necessary steps in the REACH process for you, thus securing your markets.

The only representative assumes all obligations under the REACH Regulation for manufacturers not established in the Community, starting with pre-registration and registration, the preparation of the relevant documents such as the chemical safety report and the preparation of the extended REACH safety data sheet. He must also keep and update information on the quantities imported and importers supplied.

THE LEGAL BACKGROUND - ARTICLE 8 OF REGULATION 1907/2006:

1. a natural or legal person established outside the Community who manufactures a substance on its own, in preparations or in articles, formulates a preparation or manufactures an article that is imported into the Community may, by mutual agreement, appoint a natural or legal person established in the Community to act as his sole representative for the purposes of fulfilling the obligations incumbent on importers under this Title.

 

2. The representative shall also fulfill all other obligations for importers under this Regulation. To this end, he shall have sufficient experience in the practical handling of and information on substances and, without prejudice to Article 35, shall keep and update information on the quantities imported and customers supplied and information on the submission of the latest version of the safety data sheet referred to in Article 31.

 

3. where a representative is appointed in accordance with paragraphs 1 and 2, the manufacturer not established in the Community shall inform the importer(s) in the same supply chain thereof. For the purposes of this Regulation, such importers shall be considered as downstream users.
